The Hidden Risk of Uncertified Service

Across the Southeast, school districts, transit agencies, and fleet operators routinely assign in-house maintenance staff to service wheelchair lifts and bus A/C systems. In most cases, these technicians — however skilled at general mechanics — lack the manufacturer-specific training, federal certifications, and regulatory credentials required by law to perform this work. The consequences are not hypothetical. They are financial, legal, and in the worst cases, catastrophic.

The Problem

Wheelchair lifts manufactured by BraunAbility, Ricon, Harmar, Bruno, and Maxon are complex electro-hydraulic safety systems governed by FMVSS 403 and 404. These manufacturers only provide technical training and certification to authorized dealers — not to end users, school district shops, or general fleet mechanics. Servicing these lifts without manufacturer certification voids warranties, violates FMVSS compliance, and creates direct liability for the organization if a lift fails and injures a passenger.

Bus A/C systems contain regulated refrigerants that are illegal to handle without EPA Section 608 certification. Despite this, in-house fleet technicians routinely recharge, repair, and vent A/C systems without holding valid EPA credentials — a direct violation of the Clean Air Act. Every uncertified refrigerant handling event is a separate federal violation.

The liability is clear: if an uncertified technician services a wheelchair lift that later malfunctions and injures a student or passenger, the school district or transit agency bears full legal responsibility — including negligence claims, wrongful injury suits, and regulatory penalties.

The Penalties

EPA Clean Air Act (Section 608): Civil penalties up to $44,539 per day per violation for improper refrigerant handling by uncertified technicians. Knowing violations can reach $500,000 per violation. In 2024, refrigerant violations accounted for over 30% of all EPA penalties nationwide.

NHTSA / FMVSS: Civil penalties up to $75,000 per violation for non-compliance with Federal Motor Vehicle Safety Standards, including improper wheelchair lift maintenance that renders the lift non-compliant with FMVSS 403/404.

ADA Non-Compliance: First violation fines up to $115,231, increasing to $230,464 for subsequent violations. If a wheelchair lift fails due to improper service and denies access to a passenger with a disability, ADA liability attaches to the operating organization.

The Risk of Unlicensed Stairlift, VPL & Elevator Work

Every state we operate in regulates the installation, service, and repair of stairlifts, vertical platform lifts, and elevators. Unlicensed work is not just risky — it's illegal.

Stairlifts, vertical platform lifts, and residential elevators are classified as conveyance devices and regulated under state elevator safety codes in every state Custom Mobility serves. Georgia, Florida, Tennessee, North Carolina, and South Carolina all require some combination of licensed elevator contractors, certified elevator mechanics, installation permits, and state inspections before this equipment can legally be installed, altered, or repaired. Despite this, unlicensed handymen, general contractors, and online sellers routinely install this equipment without the required credentials — exposing homeowners, building owners, and facilities to significant legal and safety liability.

The Problem

Georgia requires a Class IIIR elevator mechanic license issued by the Commissioner of Insurance and Safety Fire to install or test stairway chairlifts and platform lifts. Installation and testing must be performed by a licensed mechanic, and a signed test report is required before the equipment can be used. Contractors must hold a valid Elevator Contractor Class III or IIIR certificate with proof of annual continuing education.

Florida requires a Certified Elevator Technician license to construct, install, maintain, or repair any vertical conveyance — including stairlifts and wheelchair lifts — in non-residential settings. Companies must be registered elevator companies with permits issued by the Bureau of Elevator Safety before any installation begins. Technicians must demonstrate four years of verified experience and pass state examination.

North Carolina requires an electrical license and installation permits from the NC Department of Labor Elevator and Amusement Device Bureau for stairway inclined lifts and vertical wheelchair lifts. Prints and applications must be approved before installation begins.

Tennessee regulates stairlifts and platform lifts under ASME A18.1 through the Department of Labor Elevator Unit, which performs semi-annual inspections on approximately 15,000 conveyances statewide and issues annual operating permits.

South Carolina requires Certificates of Operation, construction permits, and contractor registration through the Department of Labor, Licensing and Regulation for elevator and lift installations.

The Consequences

Criminal penalties: Performing unlicensed elevator or conveyance work is a misdemeanor in multiple states, carrying fines up to $1,000 per offense and potential imprisonment up to 10 days per violation.

Civil penalties: State regulatory agencies can issue citations ranging from $250 to $1,000 per violation, with escalating penalties for repeat offenses and administrative complaints that can revoke business licenses.

Insurance voided: If equipment installed by an unlicensed person fails and causes injury, the property owner's insurance carrier can deny the claim based on the illegal installation — leaving the owner personally liable for all damages.

Liability exposure: Building owners, facility managers, and homeowners who hire unlicensed installers assume full legal liability if the equipment malfunctions. If someone is injured on an illegally installed stairlift or VPL, negligence claims attach directly to whoever authorized the unlicensed work.

Failed inspections: Equipment installed without permits will fail state inspections, potentially resulting in red-tagged equipment that cannot be legally operated until a licensed contractor brings it into compliance — often at significant additional cost.
